This document contains the terms and conditions applicable to purchases made through this website, as well as the conditions of use thereof (hereinafter, the “Terms”). We recommend that you read them carefully, along with our Privacy and Cookies Policy, before placing any order. Hereinafter, “KALA”.

Use of the website

These Terms are the only conditions applicable to the use of this website. Making a purchase implies your acceptance of them.
By accepting them, the user declares that:
1. They will use the website only to make valid inquiries or orders.
2. They will not place false or fraudulent orders.
3. They will provide accurate and complete information necessary to process the order, in accordance with the Privacy Policy.
4. You are over 18 years of age and have the legal capacity to enter into contracts. This site may contain links to third-party websites or materials provided for informational purposes only.
KALA is not responsible for the content of such sites or the consequences of their use. KALA only sells its products through www.kala.es, and therefore is not responsible for any counterfeits or resales outside of this official channel.

How to complete a purchase

You can browse the categories and product pages to find out about their characteristics, composition, or availability. If an item is out of stock, you can leave your email address to receive a notification when it becomes available again.
To make a purchase:
• Select the product, color, and size (if applicable).
• Add it to your cart by clicking “Add to cart.”
• Review the selected items before confirming payment.
• The total will show shipping costs, if applicable.

If you have a promotional code or gift card, enter it in the corresponding field. 
No purchase contract will exist until KALA accepts the order by sending a shipping confirmation email.

KALA may not accept an order in the following cases:
• Technical or typographical error in the price or product information.
• Lack of stock or availability.
• Lack of legal age or incorrect information.
• Suspicion of fraudulent or speculative order.

The cancellation or modification of an order depends on its status. To request this, contact pedidos@kala.es, indicating your order number in the subject line.

Once the purchase has been confirmed, it will not be possible to remove or modify items from the order; you may exercise your right of withdrawal after delivery (see clause 10).

Service availability and shipping

Each order is carefully prepared in our workshop.
When it is shipped, you will receive an email with your tracking number to follow its journey.
Order preparation: 24–48 business hours.
Approximate delivery times:
• Mainland Spain: 2–5 days
• Balearic Islands: 3–6 days
• European Union: 3–10 days

Delivery times may be extended during periods of high demand or for reasons beyond KALA's control.

We do not deliver to PO boxes.
To avoid any issues, please provide your full address and contact telephone number.

Transport incidents:
If the package arrives damaged or opened, please write to us at pedidos@kala.es within the first 24–48 hours, attaching photos of the exterior, interior, and label. We will resolve the issue as a matter of priority. Damage caused during transport is reviewed by our team and, once verified, KALA will cover the costs of replacement or repair where applicable.

Canary Islands:
Shipments are subject to local customs procedures (DUA/IGIC). These charges, when applicable, are borne by the customer. Delivery times may be extended due to customs procedures.

European Union:
No tariffs apply; delivery times may vary depending on the country.

Other destinations:
If you wish to place an order outside these markets, please write to us at pedidos@kala.es and we will find the best option for you.

KALA may offer “express” delivery options or promotions (such as free shipping above a certain amount). The current conditions will be displayed during the purchase process.

Product availability

All orders are subject to availability. If there is a stock shortage or supply issue, KALA will inform you and proceed with a refund using the same payment method used or store credit, whichever you prefer.

Product features

The products available on the website include a detailed description and a photograph. The color shown may vary slightly depending on the screen; the valid color is that indicated in the product features.

Price and payment

Prices are shown in euros (€) and include VAT, unless otherwise indicated.
Shipping costs will be added to the total before confirming the purchase.

If an obvious error in the price is detected, we will contact you to confirm the order at the correct price or cancel it. If we are unable to contact you, the order will be canceled and the amount refunded.

Accepted payment methods:
• Credit or debit card
• Klarna (subject to availability and approval)
• Apple Pay / Google Pay

Each payment service has its own terms and conditions.
Cards are subject to verification by the issuing institution. If the payment is not authorized, we will not be able to complete the sale.

Deliveries

Shipments are handled by approved logistics operators. If no one is available at the time of delivery, the transport company may make a new attempt or deposit the package at an authorized collection point. The exact procedure will depend on the assigned courier service.

If the order is not collected within the established period or is returned to the sender, the cost of the items will be refunded, but not the shipping costs.

Exchanges and returns (Right of withdrawal)

You have 14 calendar days from receipt to withdraw from the contract without having to justify your decision. 
Once you have communicated your intention to return the item, you have another 14 days to send the package.

Condition of the item:
It must be unused, with original labels and packaging.

How to start the process:
Write to us at pedidos@kala.es, indicating your full name and order number. We will send you a return label to drop off the package at a nearby delivery point.

Return cost (deducted from the refund):
• Mainland Spain: €2.95
• Balearic Islands, Canary Islands, and European Union: €5.95

We apply this cost to maintain a responsible process and avoid unnecessary transport.

Exclusions:
We do not accept returns of personalized or sealed items that are not suitable for return for reasons of hygiene or health protection once they have been unsealed.

Defective or non-compliant products

All KALA items undergo a thorough quality control check before shipment. This process ensures that each garment is shipped in perfect condition, generating internal records of the results of this inspection. If, despite this, the customer detects an anomaly not attributable to transport, they may report it to pedidos@kala.es within 48 hours of receipt, attaching clear photographs of the product and packaging.

Each case will be evaluated individually by KALA's quality department, which will verify the nature of the incident. Only if a genuine non-conformity or manufacturing defect is confirmed will KALA replace the product with a new and identical one, assuming the corresponding collection and shipping costs. Only when replacement is not possible (due to lack of stock or for justified reasons) will a refund of the amount paid be offered using the same payment method used.

If, after inspection, it is determined that the product has been tampered with, misused, or altered, the return will not be accepted, and the customer may recover the item by paying the cost of return shipping.

The legal warranty for new goods in Spain is three years from delivery, applicable only to manufacturing defects and excluding natural wear and tear, misuse, or causes beyond KALA's control.

Refunds

We process the refund once the garment has been received and verified, using the same payment method used for the purchase. In the case of partial returns, if the order no longer meets the free shipping threshold, we will adjust the refund to the corresponding standard shipping cost.
We will inform you of this during the process.

KALA may withhold the refund until the product or proof of return is received.

Promotions and commercial offers

KALA may occasionally offer prize draws, promotions, coupons, or free shipping. These offers will be subject to specific conditions communicated through the brand's official channels.

KALA may modify or suspend a promotion for justified reasons. Products obtained through prize draws or promotions cannot be exchanged or returned, except in the case of a defect. 

Gift cards

Gift cards are non-refundable. Purchases made using a gift card will be refunded, where applicable, using the same method.

Liability

Our liability for purchased products is strictly limited to their purchase price.

KALA does not guarantee the total absence of technical errors on the website or the continuous availability of the service. In the event of obvious errors in prices or information, KALA may cancel the order and refund the amount.

Intellectual property

All intellectual and industrial property rights over the content, design, photographs, and materials on the site belong to KALA or third-party licensors.

Their reproduction, distribution, or modification without express authorization is prohibited.

Data protection

Personal information is processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD).

Force majeure

KALA shall not be liable for any failure or delay due to force majeure or circumstances beyond its reasonable control (strikes, natural disasters, transport or power interruptions, etc.).

Assignment and waiver 

The customer may not assign any rights or obligations arising from the contract without prior written consent. 
Failure by KALA to exercise a right shall not be construed as a waiver of that right.

Partial invalidity

If any clause of these Terms is declared invalid, illegal, or unenforceable by a competent authority, it shall be deemed not to have been included, without affecting the rest of the document.

Modifications

KALA may modify these Terms without retroactive effect. Updated versions will always be available at www.kala.es.

Applicable law and jurisdiction

Sales made through this website are governed by Spanish law. Without prejudice to the rights recognized by law to the consumer, any dispute shall be submitted to the Courts and Tribunals, expressly waiving any other jurisdiction.
